LINKRR – TERMS OF SERVICE Operated by Flux Interactive Pty Ltd (ACN 659 631 795) 1. ACCEPTANCE OF TERMS • By accessing or using Linkrr (linkrr.store) (the “Service”) you agree to be bound by these Terms of Service (“Terms”). • If you do not agree, do not use the Service. 2. ELIGIBILITY • You must be at least 16 years old, or have a parent/guardian’s consent. • All information you provide must be true, accurate and complete. 3. ACCOUNT REGISTRATION & SECURITY • Keep your login credentials confidential. • You are responsible for all activity under your account. • Notify us immediately of any unauthorised access or security breach. 4. DESCRIPTION OF SERVICE • Create personalised storefront links and monetise content. • Send automated Instagram Direct Messages (DMs) triggered by keyword comments on Instagram Business accounts. • Upload media for products and promotions. 5. ACCEPTABLE USE • Do not send spam, harassing, abusive, deceptive or fraudulent messages. • Do not violate any law, regulation, third-party right or Instagram Platform Policy. • Do not upload or distribute malicious code, viruses or harmful content. • Do not collect, store or process personal data of others without proper consent. 6. MEDIA UPLOADS • Permitted Content – Upload only media (“Media”) you own or have licensed. • Licence Grant – By uploading Media you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify and display it in connection with the Service. • Prohibited Content – No unlawful, defamatory, obscene or infringing material. • Moderation – We may remove or disable access to Media that violates these Terms. 7. INSTAGRAM DM AUTOMATION • Use the feature solely for legitimate business communication. • Comply with all Instagram policies and messaging requirements. • Ensure messages are relevant, accurate, non-deceptive and not abusive. • Monitor and promptly address recipient enquiries or unsubscribe requests. 8. PROHIBITED ACTIVITIES • Any attempt to exploit, manipulate or harm recipients through DMs, Media uploads or other features is prohibited. • We may suspend or terminate accounts engaging in abusive, fraudulent or illegal behaviour. 9. INTELLECTUAL PROPERTY • Except for user-uploaded Media, all content, trademarks and software on the Service belong to Flux Interactive Pty Ltd or its licensors. • You may not reproduce, distribute or create derivative works without prior written permission. 10. PAYMENTS AND FEES • Payments are facilitated through **Stripe Connect**; each user acts as a sub-merchant under Stripe’s platform. • You agree to Stripe’s Terms of Service and Privacy Policy. • We may charge fees for certain features and will provide advance notice of any such fees. 11. TERMINATION • We may suspend or terminate your access to the Service at any time, with or without notice, for violations of these Terms or as required by law. • Upon termination, all rights granted to you under these Terms immediately cease. 12. DISCLAIMERS • The Service is provided “as is” and “as available” without warranties of any kind, express or implied. • We do not guarantee the Service will be uninterrupted, error-free or secure. 13. LIMITATION OF LIABILITY • To the maximum extent permitted by law, Flux Interactive Pty Ltd is not liable for any indirect, incidental, consequential, special or exemplary damages arising from your use of the Service. 14. INDEMNIFICATION • You agree to indemnify and hold harmless Flux Interactive Pty Ltd, its directors, employees and affiliates from any claims, liabilities, damages, losses or expenses (including legal fees) arising out of: • your use of the Service; • your Media uploads; • your automated DMs; or • your breach of these Terms. 15. CHANGES TO THESE TERMS • We may revise these Terms at any time. • The “Last updated” date will change accordingly. • Continued use of the Service after revisions become effective constitutes acceptance of the updated Terms. 16. GOVERNING LAW • These Terms are governed by the laws of Victoria, Australia. • Any dispute will be resolved exclusively in the courts of Victoria. 17.
